It's not that good of a picture actually... the exposure settings are all wrong and the flash is way too bright.

I kind of buy the photographers story... if he was trying to just photograph it, the picture would be better quality. Besides, there were many people closer to the altercation who could have intervened but didn't.

There's a video of it here (before he threw him on the tracks):
