Gee . . . what are the odds that two different mothers are in the same jail at the same time with the death of a child, dying "accidently" in identical manner and with the same member of the family finding the dead child!
Having all this happen in front of a jury is HORRIBLE, his creditability is SHOT at this point. If you can't believe the attorney or the defendant...Jesus who are you going to believe??
NOW question, DO YOU think he is intentionally NOT reviewing or stating he has NOT reviewed information so that he may (in his mind) get a retrial?

Happens every day.
sad, happened on Christmas day.
December 26, 2007
ORANGE COUNTY, Fla -- Christmas turned tragic for a family in Orange County Tuesday afternoon when a 15-month-old boy drowned in a backyard swimming pool.
A detective with the Orange County Sheriff's Office identified the child as Isaiah Whalen. Family members told deputies that they were observing Christmas at a home on Heaton Court in east Orange County when they noticed that Isaiah was missing.
The boy's mother and other relatives immediately launched a search around the home and the neighborhood. While searching around the pool area, the boy's grandfather spotted him face down in a murky, above ground pool in the rear of the house.
The grandfather jumped in the pool and administered CPR, which was continued by an Orange County Sheriff's deputy who arrived on the scene.
Fire rescue units transported the boy to Florida Hospital East where he died a couple of hours later.
An investigation into the incident will be conducted by the sheriff's office as well at the Department of Children and Families.
defense attorney Jose Baez said that the state handed him the new discovery Tuesday morning. Baez claimed it was a violation of Judge Belvin Perry's discovery order.
Assistant state attorney Linda Drane Burdick explained a citizen called the Orange County Sheriff's Office a week ago, saying Casey Anthony possibly had contact with another inmate in the Orange County Jail named April Whalen.
According to prosecutors, Whalen had a son who drowned in a swimming pool. The boy's grandfather found him and called 911 immediately.
Baez told a similar story in his opening statement, saying 2-year-old Caylee Anthony drowned in her grandparents' swimming pool on June 16, 2008.
Corrections officials confirmed Whalen was housed in the same area of the Orange County Jail as Casey Anthony for five days in 2009. The state said it could not confirm whether Whalen ever had contact with Casey.
Whalen has been booked into the Orange County Jail 10 times between 2000 and 2009. She was arrested on four different occasions for petit theft, four times for violating probation, and twice for driving with a suspended license, among other charges, including drug possession.
i really feel for the jury. this afternoon was another bore-fest. i only stuck around waiting for george's ho to take the stand.
just plain awful.
and jose managed to make an ass of himself again by calling Det. Yuri Melich. who chewed him up and spit him out again.
the torture will continue for about 15 more minutes. his own witness is making him look like an asshole too.
we better get the ho tomorrow or i am turning in my court reporter card.
and did you notice casey? she knotted up her sweater again so she could accentuate her boobs better for the jury. she likes to stick 'em out there in their faces.
I didn't get to watch any of the trial today. I am now watching the Botonist on the stand. Wow! It is painful to watch! What a ding-dong dumb fuck! She probably couldn't tell you if she wiped her ass this morning!
Volusia County Sheriff's detectives are investigating the drowning death of a 1-year-old boy.
A 911 dispatcher received the call around 5:18 p.m. Tuesday that the toddler was at the bottom of the pool at a home in the 700 block of Leeward Drive.
The child was not breathing when he was removed from the pool.
A dispatcher tried getting the frantic caller to perform CPR on the boy until emergency workers arrived.
Officials said the boy's mother, father and grandparents were home at the time.
The boy was rushed to Florida Hospital Fish Memorial in Orange City where he was pronounced dead.
me:
i lived and worked in florida for a number of years. and it's true, little ones die in swimming pools all the time. i remember TWO cases of twins who drowned in pools in Jax. last year! it only takes a few minutes and a parent who loses sight for a few minutes. little ones are fast and resourceful. pools are very attractive to little ones. there are laws about fences etc. but still it happens every year with tragic regularity. it's an ugly little fact about 'paradise' because pools are as common as palmetto bugs.
i had an inground pool, but i wouldn't have if i had a toddler. because all it takes is for a child to open an unlocked slider door from the house. my son was 9 when i put the pool in, and he and his friends were not allowed in unless i was home watching. the pool had a locked screenhouse too, exactly as picture shows below. but those above-ground pools don't.
do i think that's what happened to Caylee and her LEO-trained grandfather failed to call 911 or try CPR?
HELL FUCKING NO. why would he?? was he some irrational nutfuck and so was she? these things happen all the time, it's negligence and accidents, not murder.
nobody else here thinks so either, but i was struck by this little news article early this morning, almost like a message to everyone viewing the trial.
I can not believe that bitch is trying to use the drowning theory! There is NO fucking way your gonna see ur child at the bottom of ur pool and NOT CALL FOR HELP! As a parent you hold on to any little hope you may have. This part of the case gets to me the most. It makes her an ever sicker bitch in my eyes! disgusting!
Oh for the love of God! What the fuck is this motard doing calling all the witnesses the State has already called and he's already cross examined!!! This is a total WASTE of time and all he's doing is stalling! Put that on the stand already you !!!
Court is recessed at 12 noon today, so basically he's just wasted the courts time again!!!!!!!!!!!!

I have felt the same way as you, but I do not understanding why he is stalling. THIS if anything will piss off the jurors, showing them he has NO DEFENSE.
The judges job is not "the official clock watcher"
This judge rushing the defense could be the basis of appeal.
.
Definition and Nature of the Work
Judges preside over trials and hearings in federal, state, and local courts. They rule on the admissibility of evidence, monitor the testimony of witnesses, and settle disputes between prosecutors and defense attorneys. When standard procedures do not already exist, judges establish new rules based on their own knowledge of the law. They must ensure that all proceedings are fair and protect the legal rights of everyone involved.
Our Constitution was made only for a moral and religious people. It is wholly inadequate to the government of any other.
John Adams
IMaDick,
No one is implying that the judge is watching the clock. He clearly stated yesterday that he had other business to attend to so court would only be 1⁄2 day. Baez is just stalling because he HAS NO CASE! This is has turned into a complete circus!
Judge Perry is being very patient. I have not once heard him say to baez to move it along. Or rush him in any way. Surely, baez has his CIC planned out. Surely, baez knows how many more of the State's Witnesses he is going to call. And how much more evidence that was not found that he wants to enter into the not found evidence. What a waste of time. This could have been done on cross, imo. But this is the defenses strategy, or so it seems. I call it a lazy ass defense.
...the defense called Madeline Montgomery, a forensic toxicologist for the FBI, as their next witness.
Montgomery examined a hair found with Caylee's remains. She told jurors she found no trace in the hair sample of a number of drugs, including ones that can have a sedative or knock-out effect.
baez then asked, "What other meaningless tests do you do at the FBI?"

casey hears that the jail has run out of green bologna.
i'm going to do a post sometime soon about the death penalty in florida and how it may affect this trial/defendant. but this was worth posting today because i feel sure it will be cited at some point by baez:
MIAMI (AP) — A Miami federal judge has ruled that Florida's method of imposing the death penalty is unconstitutional, but the decision alone does not strike down the law.
The ruling Monday by U.S. District Judge Jose Martinez applies only in the case of convicted murderer Paul H. Evans, who is on Florida's Death Row. The ruling means that Evans will get a new sentencing hearing.
Martinez said Florida's system violates the Constitution because jurors are not required to announce specific findings on aggravating factors required to justify the death penalty. The jurors make only a general recommendation of death or life by majority vote. The final decision is up to a judge.
The U.S. Supreme Court in 2002 held that jurors must determine the specific aggravating factors.
some background on george's ho & her sister. 2010 article.
for the record, george denies all of it.
WESH "This new statement reaffirms that George Anthony never had an affair with the woman, never took any money from her and never confided in her about the case against his daughter."
and if baez puts her on the stand Ashton will make bloody shark chum out of her.
i can hardly wait!
WKMG
ORLANDO, Fla. -- There is more information being learned about the backgrounds of the two sisters who have spoken to the tabloid media to claim one had an affair with George Anthony, the father of Casey Anthony, who is charged in the killing of her daughter Caylee.
The two have been using the names River and Skye, and they have talked to the likes of the National Enquirer. They are twins who also have been arrested a number of times.
Cecelia Holloway is also known by another name to publicize her sister's supposed affair with George Anthony: Skye Benhaida. She claims to be the sister of River Cruz, who is also known as Cecelia's 38-year-old twin sister Krystal Holloway.
Cecelia Holloway went on national television on the "Nancy Grace" program to support her sister's story, detailed in the Enquirer on Wednesday, of an affair that the two are claiming Krystal had with George Anthony while his grand-daughter Caylee Anthony was missing. The girl was later found dead.
George Anthony denies an affair, his attorney Brad Conway said.
Cecelia hasn't always been so supportive of Krystal's stories. In a June 2009 letter to a judge handling a domestic battery case against her husband, Cecelia wrote that Krystal lied to police about the incident.
"My sister…(Krystal) … called the police and told them he beat me up," Cecelia wrote. But Cecelia went on to argue that was a lie.
"My sister does not like my husband, there for (sic) I believe is why she had him arrested," Cecelia wrote.
Local 6 also found that Cecelia was in jail from August 2008 to January 2009, the time the two sisters claim the affair was supposedly blossoming.
Local 6 shared that finding on Wednesday with George Anthony's attorney, who had done some investigating of his own.
"It says they are questionable people," Brad Conway said.
The two women also made a joint appearance in another crime report in February 2008 after more than $1,000 in jewelry was stolen from an apartment neighbor of the twins.
The thief who brought jewelry to a pawn shop presented a driver's license with Krystal Holloway's picture on it, but left behind a thumb print on the pawn slip that belonged to Cecelia Holloway, so she's the one who got five months in jail.
In fact, on the day Casey Anthony was being escorted out of jail on Aug. 21, 2008, Cecelia Holloway was being booked there for violating probation on another conviction in Seminole County for dealing in stolen jewelry.
(CNN) -- The parents of Casey Anthony do not believe she is innocent, their lawyer told CNN.
George and Cindy Anthony do not, however, want their daughter to receive the death penalty for the killing, said lawyer Mark Lippman.
Casey Anthony, 25, is charged with seven counts in her daughter's death, including first-degree murder. If convicted, she could face the death penalty.
Lippman's bombshell statement to CNN's Gary Tuchman was discussed on "AC 360" Wednesday night. It is unclear how the remarks would affect testimony that is scheduled to continue in Anthony's capital murder trial Thursday.
