well this certainly implies an arrest is coming. the civil and criminal should NOT overlap. the divorce should proceed as an independent issue. but for some reason she is afraid of being under oath.
Multnomah County Judge Keith Meisenheimer decided this afternoon to delay until Jan. 6 the divorce proceeding between Kaine Horman and Terri Moulton Horman.
The judge called the issues "extraordinary, difficult and complex," and unlike any that's come before state family law court.
He said he had to weigh Terri Horman's constitutional rights with Kaine Horman's interest in a prompt resolution of the custody, parenting and financial matters in the divorce.
He said Terri Horman's lawyers could return to him, if they sought to extend the divorce delay.
Meisenheimer said he was convinced there is a "substantial overlap at least in the relevancy of the evidence" in the pending civil case and the ongoing criminal investigation into Kyron's disappearance.
"Though it's pre-indictment, Ms. Horman has very substantial legal risk in the dissolution case," Meisenheimer said.
"The highest interest in this whole proceeding is to try to find the child alive," Meisenheimer said.

PORTLAND, Ore. - In the latest court filing by Kaine Horman, the father of missing 8-year-old Kyron Horman, he said he strongly believes that his estranged wife, Terri Horman, “abducted and may have caused unimaginable harm to (Kyron),” a KATU News source confirmed Friday.
The court filing is a response to Terri Horman’s desire - three and a half months after Kyron disappeared from Skyline School - to see their daughter, Kiara, who is almost two years old.
Kaine said Friday that he really doesn’t understand why this desire to see Kiara is coming now from Terri.
Terri Horman did not first hire a family attorney to seek visitation with her daughter but instead hired an expensive criminal defense attorney, Stephen Houze. Then allegedly she had phone sex with another man.
Kaine said he does not believe that Terri should see their daughter because it would not be in the best interest of the toddler. He also does not believe supervised visitation would be wise. In addition to the physical harm he believes Terri caused Kyron, he believes there is a risk of emotional and psychological harm with the two being in the same room.
In the court filing, Kaine says that Terri’s odd behavior “cannot be taken lightly (by the court) when making decisions affecting the well-being of an almost two-year-old child.”
Kyron Horman disappeared from his elementary school June 4. His stepmother, Terri Horman, was the last known adult to see him.
Investigators have not named her or anyone else a person of interest or suspect in the case, and they have not made any arrests.
MEDFORD, Ore. -- In an exclusive interview on NBC's Today Show, Kyron Horman's mother said she thinks the missing 7-year old's step-mom could have hurt her son "in the worst way."
Desiree Young appeared on Today Monday morning. She talked about explosive emails that police showed her just last Friday. The emails were sent to friends by Terri Moulton Horman, Kyron's step-mother, according to Young.
"I now believe without a shadow of a doubt that not only is she (Terri) capable of hurting Kyron, but that it's clear she could have hurt him in the worst possible way, " said Young, as she struggled to talk through the tears.
But what were in those emails?
Young said she couldn't go into specifics because of the ongoing investigation. But she didn't hold back about the ugly picture she said the emails painted.
"It's very clear from Terri’s horrible words that she had a severe hatred for Kyron and that she blamed a lot of the marital problems on Kyron," said Young.
Kyron Horman went missing from Skyline Elementary School on June 4th. While Terri Horman has not been named as a suspect, she has clearly remained the focus of the investigation.
Desiree Young and Kyron's father Kaine Horman have long provided a united front in the search for their son.
But on Monday, Desiree indicated she was seriously disappointed with Kaine for failing to share with her information of Terri's alleged issues with alcohol.

"I just can't stand by and support the choices that he's making. He had several opportunities to let Tony (Desiree's husband) and I know what was going on and he did not, " she said.
"We learned all of this information after the fact and from the media. He had several opportunities to let Tony know, and I know, what was going on, and he did not, she said."
Young also said that she tried to get custody of her son a year before Kyron disappeared, but Kaine would not allow it. Young said Terri even called her on the phone to urge her to take over custody of Kyron because he was so upset.
"He (Kyron) was exhibiting some problems in school, expressing a lot of sadness, and upset at the situation. Kyron on many occasions said he wanted to live with me, " she recalled.

PORTLAND, Ore. – The Multnomah County Sheriff's Office Search & Rescue Unit fought the fog Sunday to search two portions of Portland's West Hills – at the request of the Kyron Horman Task Force.
"I have been waiting for this search to happen for some time now," said Desiree Young, Kyron’s biological mother. "The Kyron Horman Task Force has shared the intelligence information with me, but unfortunately I can’t share that information with the media. I'm excited that today’s search will hopefully bring some closure to this case.”
Dozens of search-and-rescue workers, along with seven cadaver-detecting dogs, are combing the forest along a 6-mile stretch of Northwest Skyline Boulevard. They also will be searching off of a gravel road in Skyline's Dixie Mountain area. That area reportedly could not be searched in previous weeks due to snow cover.
A spokesperson confirms that Sunday's efforts are being done in the hopes of bringing "closure" to the nearly 8-month-long search for missing 8-year-old Kyron Horman. Kyron was 7 when he is believed to have disappeared from a science fair in rural Northwest Portland's Skyline School.
Searchers focused on two locations in the west hills: north and west of Portland. We're told these two search locations are based on investigative leads developed by the Kyron Horman Task Force. The search was expected to continue throughout the day Sunday.
The private timber land crosses into unincorporated areas of Multnomah, Washington and Columbia counties. The Oregonian reports that it reaches elevations of between 1,000 and 1,500 feet.
WEB UPDATE 4:45 p.m. 1/30/11: A credible source, who is close to the investigation, tells us that – despite previous reports to the contrary – no vehicle nor personnel connected to the State Medical Examiner’s office or any county coroner’s office was involved as part of Sunday's searches.
That source also tells us these searches were conducted based on “some reasonably location-specific information.” However, nothing of significance was found.
UPDATE 5:52 p.m. 1/30/11: We have just received word that as of now the Multnomah County Sheriff's Office is suspending its renewed search in the Skyline area.
"The searches have concluded for the day," reads a prepared statement from the Multnomah County Sheriff's Office. "There were 11 areas designated to be searched by canine teams; seven of these area[s] were searched. There were also three other area[s] designated to be searched by ground crews; one of these areas was completed."
The sheriff's office reports it has yet to determine the date for the completion of this renewed search.

Kyron Horman's mother said today she has begun to put new pressure on the missing Oregon boy's stepmother with a clear message: She will not stop until Terri Horman is "brought to justice.
Desiree Young spoke with "Good Morning America" today from Roseburg, Ore., the town 200 miles from where Kyron was last seen and the new home of Kyron's stepmother, Terri Horman.
Kyron Horman disappeared the morning of June 4, after participating in an early morning science fair at his suburban Portland elementary school. Police said he was last seen walking down a hall at the school with his stepmother.
"Kyron's story is not one of a child that wandered away from his school or was abducted by a stranger," Young said Saturday at a news conference in Roseburg. "It was somebody who was brought into our family. ... There is one person that knows where he is: Terri Horman, where is Kyron?"
On "Good Morning America" today, Young said she has gone to Roseburg to distribute flyers urging people in the small town to keep asking that question of Terri Horman, the last person known to see Kyron.
"I believe that it was important to raise awareness in Roseburg, [where] people are not aware of who I am, who Kyron is, let alone Terri, who lives here," Young said.
"It was concerning, because we have knowledge that she's handing out Halloween candy to children, she's going into bars, and enjoying the holidays with her family -- all while Kyron is not here. We thought it was time to step it up a notch," she said.
Young also said investigators presented her with new evidence that she said raises questions about Terri Horman's character.
"[The evidence] indicated that not only could Terri be capable of this, but it was clear that she hated Kyron, and blamed everything on Kyron -- and had expressed that on various occasions to friends and people that she knew," she said this morning.
This case has bee so sad to me. Such a darling, darling little boy. Like LC, I thought Terri was faking in those initial press meetings. Harming that sweet child is incomprehensible to me.
Yeah, poor Kyron. I remember the day he went missing. I don't understand how nobody saw him leave the school? There had to be a lot of parents around because of the science fair. And the teacher should have asked for a written note, not a verbal, for the doctor's appointment. That would be worth so much right now. I hope he is alive and safe. Just because it has been almost a year doesn't mean anything. Jacy Duggar was missing for years before she was finally found. Also, there was a boy that was found a few years ago, not sure of name, after he went missing for 3-5 years. Does anybody know why there isn't any coverage, except through local media? When Caylee Anthony was missing, already presumed dead, there were daily updates.

My heart skipped a beat when I saw a new post on this thread-hoping there was a break in the case. Makes me sick to think that the guilty party is not locked up for what they did to Kyron.
It's the hint of arsenic that gives it that extra kick.
