The jury is in its 4th full day of deliberations today.
I think that if Digoxin isn't on the drug list for the 4 women of the fetuses/babies in question, it could constitute premeditation and cruelty in the minds of some jurors, even those who might be more tolerant of abortion on the whole. In that case, in my mind, it would be reasonable to expect that live babies could exit the womb.
Update:
The jury asked for help Friday distinguishing among the four babies Gosnell is accused of killing. Staff members at Gosnell's clinic have testified that they saw each one move, breathe or whine outside the mother's body before they were allegedly killed.
The jury has also asked for a list of drugs found during a 2010 clinic raid. Prosecutors say the abortion drug Digoxin was not found - although Gosnell says he used it to stop the babies' hearts in utero during late-term abortions.
The jury has been weighing more than 250 counts against Gosnell and a codefendant since Tuesday.

Yesterday:
The jury heard the testimony of Adrienne Moton (read back), the first of Gosnell’s former employees to testify. Moton previously pled guilty to one count of third degree murder for snipping the spinal cord of Baby D, two counts of conspiracy and one count related to corrupt organizations. Her guilty plea allows her the possibility of a lighter sentence based on her cooperation with the prosecution. She has not yet been sentenced.
In perhaps a glimpse into the emotional state of the jury, they questioned Judge Jeffery P. Minehart about the 227 counts of violating the 24-hour informed consent law. The Defense stipulated that the forms in all 227 files were signed on the same day as the abortion procedure was done. The jury asked if the files were the only evidence of those misdemeanor counts and whether they could issue one verdict for the entire lot of charges. The News Journal reported that some of the jurors appeared somewhat downcast when told they had to reach 227 separate verdicts on those counts.

Gosnell faces first degree murder for the death of Baby D, who was delivered into a toilet at his “House of Horrors” abortion clinic and was seen moving in “swimming” motions in an apparent attempt to get out of the toilet bowl.

The jury deliberating in the capital murder trial against former Philadelphia abortion doctor Kermit Gosnell says they're hung on two counts.
The jury of seven women and five men are weighing more than 250 charges against the Gosnell with the most serious being four counts of first-degree murder.
It is currently unclear on which charges the jury is deadlocked, but the group told the court it has reached unanimous decisions on all other counts.
Around 10:00 a.m. Monday, the jury passed a note to Common Pleas Judge Jeffrey P. Minehart explaining their situation. The admission came on the 10th day of deliberations.
By law, according to attorneys for both sides, Judge Minehart is required to re-instruct the jury to deliberate on the two charges a second time and attempt to reach a verdict.
Judge Minehart brought the jury into the courtroom on the third-floor of the Philadelphia Criminal Justice Center around 11:15 a.m.
Over a five minute meeting, he reminded the jury they must be unanimous on all counts and asked the group to return to the jury room and discuss the charges further. The group was grim-faced as they were led from the court.
Judge Minehart called the jury sincere, considerate and serious. The judge also said he wanted to make sure the group was not confused over the charges.
The jury now has three options: return to court with a question, request to re-examine evidence to try and break the deadlock or re-iterate they'll be unable to reach a consensus on the charges.

My guess is their is a juror believing they are taking a stand for abortion rights by not voting to convict on the murder charges.

FINALLY.
Guilty of three 1 st degree murder charges. Death penalty phase starts next week.
Acquitted on the fourth charge of 1 st degree murder.
Also guilty of involuntary manslaughter in the death of the 41 year old woman who died in the clinic.

Amazing that a case like this seemingly sat on the back burner while Jodi Arias was front page news. I guess if there's not a white, female protagonist, it's not newsworthy.

I also think that the politics of abortion + the fact that the victims had no voices/personalities/photos with which to identify + the reality that the baby victims' parents didn't want them to live (rather than being sympathetic surviving victims who who were robbed of wanted/loved ones) = major reasons that this case attracted fewer followers than some others. Not saying that the victims were any less victimized and the murderer is any less a monster; I think the jury got it right. Just that the factors I listed are amongst those that differentiate this case from widely followed ones like OJ, Scott Peterson, Casey Anthony, Drew Peterson, Jodi Arias...
With first degree murder established for Gosnell, I think aggravation is almost attached by default. Since the jury essentially voted that the babies were alive and defenseless, rather than stillborn, cruelty as a component of the murders seems almost a given to me.
For some reason, I have a feeling that he won't be given the death penalty, but I think the prosecutors have a strong case for it. Dr. Death may just die on the row - couldn't happen to a nicer guy.

I have read all over FB tonight about Pro abortion ppl yada yada yada and what few say is there a HUGE difference in ProChoice and proaboration.
That being said, I am glad there was not that much media coverage. My 11 yr old does not need to see this stuff on TV.

Sentenced to Life Without Parole - Death Penalty off the table
Dr Kermit Gosnell, 72, gave up his right to appeal in exchange for two consecutive life sentences without parole for the 1st degree murder convictions.
(He has yet to be sentenced for one murder charge, an involuntary manslaughter charge and hundreds of lesser counts.)
