check points are legal, they have been challenged several times in the supreme court and found to be constitutional.
but if it's a DUI check point then why ask for my insurance card, registration and where I'm going, where have I been, shouldn't the only question be have you been consuming alcoholic beverages?

And that was my gripe (one of'em) in the OP, Dick...how did the Supreme Court find checkpoints constitutional? Is that not akin to stopping Joe Blow walking down the street, and searching him for a weapon/drugs/whatever w/o cause?

It is, and police can actually do what you mentioned.
If a cop wants in your pockets there are many tools that can be used to get there.
personally I never speak at a check point, I don't answer questions, I hand them the drivers license,registration and insurance.
they can ask me all night where i have been or where im going they will never get an answer.

To be honest, the CP's arent very common in my state..I've only heard of a few being mentioned in the local news. I myself, have never had to go through one (as normally they are a nighttime thing, and I'm long past my bar-going days). I'm not sure how I'd deal with it.
But to argue with you a bit, I don't believe the police can randomly, and legally, stop any Joe Blow walking down the street and ask him/her to subject to a search without just cause...is that what your saying? If so, even the most incompetent public defender would get any evidence seized during such a search could get that evidence thrown out of court.

may be you should spend a little time informing yourself.
an officer can ask anyone for id at just about any encounter.
once that has happened then it's just a matter of the right questions to get in your pockets.
even if it's under officer safety, if they want it to happen it will.

Sure, an officer can spin anything he'd/she'd like. I agree..but that's basically dishonest...and I do realize that happens, especially in the larger cities, They won't call it racial profiling, but that's really what it is. But should the officer be totally honest in court, and say "I checked this fucker because he looked like a gangster", instead he/she would end up saying ""It appeared this person had a weapon in his waistband, so I confronted him/her"
LC would certainly agree, albeit maybe not publicly now (shit, she's even afraid to post her picture) that the police will work around the law so it's basically he/she can justify the action of unreasonable search and seizure.
With that being said, however...I'm not really so much against this aspect..if a cop were to see a known gangbanger, or whatever walking down the street..and were to confront him/her.. and use any possible reason to prevent any further crimes being perpetrated by this individual to get him off the streets..I'm cool with that. But, IMO, that's completely different than stoppping every damned car on the road and questioning them.

Around here they post a notice in the paper about where and when they'll have checkpoints. If you're stupid enough to miss that and drive to one drunk, you deserve to have your ass handed to you.
