The boy who brought the gun to kindergarten could face disciplinary action including being sent to an alternative school for up to 180 days.
Houston police spokesman Victor Senties said it was too early in the investigation to say if any charges would be filed. Officers have declined to discuss the case.
Texas law is clear: having a gun within a child's reach is a crime. The 6-year-old may not face criminal charges, but the school district has a zero-tolerance policy and he will likely be sent to one of the district's alternative education schools.
A parent or a guardian of the student may now face felony charges.
"You keep loaded guns around where children can get them, it's not just a tragedy waiting to happen, it's criminal responsibility on your behalf, as well," said KHOU Legal Expert Gerald Treece.

Police investigators said a Satellite Beach father failed to properly store a handgun with which his son accidentally shot an 11-year-old friend.
Michael J. Capozzi, 42, was arrested Tuesday and charged with culpable negligence in the failure to safely store firearms, a third-degree felony punishable by five years in prison.
In the incident inside Capozzi's house, the boy suffered a serious gunshot wound to the chest.
That same thing happened in Compton a few months ago (gun falls out of backpack and discharges at a school hitting someone). But guns don't kill people, people kill people. Unfortunately stupid, irresponsible, criminal type people can get guns...and apparently, so can children.

TELFERNER, Texas -- Authorities say a 4-year-old boy is dead after being shot in the stomach by a 5-year-old sibling who was playing with a bolt-action rifle in the family's Victoria County home.
Victoria County authorities on Friday were still investigating. The shooting happened late Wednesday, and authorities said the children's parents were home at the time.
Chief Deputy Terry Simons told the Victoria Advocate that investigators are trying to determine why the children were left unsupervised. The parents drove their wounded son to a nearby grocery to meet with paramedics, who then rushed the boy to a hospital.
No names or gender of the other sibling have been released.
