TACOMA, Wash. -- A state prosecutor says the husband of Susan Powell is the subject of a pornography and voyeurism investigation.

Josh Powell denied the accusation from the assistant attorney general for Child Protective Services, John Long, who spoke at a hearing to determine who will take custody of the couple's children.

Long said he could not divulge more about the investigation.

Susan Powell has been missing since 2009. Josh Powell has been the only named person of interest in the case, but he has never been arrested or charged.

The children were placed in state care after Josh Powell's father, Steve Powell, was arrested for and charged with voyeurism and child pornography.

Following the arrest, Susan's father, Chuck Cox, asked the court for custody of the children.

In court on Tuesday, Josh Powell said he never saw any pornography at the house in Puyallup where he lived with his children and father. LIAR

He told a judge he'd be moving out of the house and that his family would not be posting bail for Steve Powell, who remains in the Pierce County Jail.

"There is no clear and present danger" to my sons, he told the court.

Josh argued that the children would be safer with him than the Cox family, who he accused of orchestrated a finger pointing campaign against him in his wife's disappearance.

"These people have a clear hatred for me and my family," he said.

A reporter from the Salt Lake Tribune tweeted that Mr. Long revelaed in court that 15 computers were seized from Steve Powell's house. That's a lot of computers. Hinky.

And, this morning, it is confirmed that the Powells have custody of Susan's boys.

The boys were placed in foster care after Steve Powell's arrest, but by Tuesday Child Protective Services had turned them over to their maternal grandparents.

Downing told the judge that the children were being harmed because they had never received counseling about their mother's disappearance, they might have been exposed to the inappropriate videos, and they had been cut off from their maternal grandparents without explanation.

Ah, I see LadyCop. The Powells were awarded temporary custody, but they don't have physical custody yet because the judge is considering Josh's objections right now. Some confusion in media reporting about this.

On the edge of my seat. I just read that the judge blocked live streaming and the media is causing some of the delay in the decision regarding custody. If true, it's idiotic. Tacoma, Wash. • A judge here has ruled the children of missing Utah mother Susan Cox Powell will remain in state custody for now, saying it is not safe for them to continue living with their father, Josh Powell.

Pierce County Superior Court Judge Kathryn J. Nelson made the ruling just after 3 p.m. MST.

The state’s Child Protective Services (CPS) temporarily placed the boys, ages 6 and 4, with Susan Powell’s parents, Chuck and Judy Cox, on Tuesday. Wednesday’s ruling means they will remain in their grandparents’ Puyallup home.

An attorney representing CPS, John Long, told Nelson Wednesday there are many good reasons that warrant keeping the children in state custody instead of with their father, Josh Powell.

-AG Long said that Josh is under investigation for voyeurism and pornography.
-AG Long said that Josh admitted to taking photos of people's legs in public without their knowledge (Josh denies).
-AG Long said that there were 15 computers taken from the house and they have only gone through a small fraction of it. Already found the porn for which Steven Powell was arrested. Josh says most of the computers were not connected and he didn't know about the porn.
-AG Long said Josh's younger brother is mentally ill and has answered door to LE in the nude with Josh's kids at home (Josh says he was unaware).
-AG Long said a poster of a woman with a sword going in her vagina and out her stomach was hanging in the house (Josh says not aware of it, but if it was there it would be taken down so boys didn't see it).
-AG Long said a hangman's noose found in the house (Josh says it's for exercise).

-Josh Powell said no one is going to bail out Steven Powell and he would turn him in if he knew his father did anything illegal.
-Josh Powell said he knew nothing about any pornography and did not participate.
-Josh Powell said he had nothing to do with Susan's disappearance, he loves and misses his wife and wants her back.
-Josh Powell said the children are safe with him at his dad's house. Dad won't be coming back. Brother will move out if necessary to get the boys back.

-Judge says: Children will stay with Chuck and Judy Cox for now!

-Josh Powell says he still objects, for the record. He doesn't want the boys going to their church, so Judge made visitation on Sunday morning.

GRAHAM, Wa. – An explosion at a Washington state home has killed Josh Powell, the husband of a missing Utah woman, plus their two young sons, officials said Sunday.

The explosion occurred moments after a Child Protective Services worker brought the two boys to the home for a supervised visit, Graham Fire and Rescue Chief Gary Franz told The Associated Press.

Powell let the boys in the house, then blocked the social worker from entering. The social worker called her supervisors to report that she could smell gas, and the home exploded.

"Everything we know right now, this has become a crime scene," Franz said.
