Michelle Le (26) missing, Hayward, CA 5/28/2011

...The decomposed remains were found by a volunteer - 10 days after Esteban's arrest - off a dirt path between Foothill Road and railroad tracks, west of Interstate 680 and south of the Castlewood Country Club in Pleasanton. The remains were found in the area where police believe Esteban dumped Le's body.

Cell phone records show that after Le disappeared from Kaiser Permanente Medical Center's garage, both women's phones "traveled on a similar path" to the Niles and Sunol Canyon areas in Alameda County, police said.

...Steve Clark, a former Santa Clara County prosecutor now a defense attorney, said Monday before the remains were identified, "If this is in fact Michelle Le" body, this is a huge piece of the prosecution case, because it then establishes Michelle Le is dead. They get over that hurdle. But it may be also that there's forensic indications of how Michelle died.

"They're going to spend a lot of time in an autopsy trying to establish cause of death," Clark said. "Now, it is difficult because the body has been gone for many months, but it is an important piece of the puzzle, and it's also something that the defense is going to want to analyze, to see if cause of death can be established - or lack of a cause of death. That's helpful to the defense."

The suspect in Le's slaying, former high school friend Giselle Esteban, 27, of Union City made a brief appearance Monday morning at the Hayward Hall of Justice but did not enter a plea. She will return to court next week.

Esteban did not enter a plea on Monday; her attorney asked for more time.

LE claims Esteban killed Michelle because she thought Michelle was getting too close to her ex. Esteban says the ex is the father of the baby she is carrying (along with her 5 year old son). Michelle's cousin said there was no romantic relationship between Michelle and the ex; they were just friends. Looks like LE has good physical evidence, according to the article in People.

Snipped:
Hayward police say they've got plenty of evidence against Esteban, including Le's DNA on one of Esteban's sneakers, security camera footage of Esteban at the hospital parking structure before and after Le disappeared, and cell phone records that show both women's phones traveling a similar route immediately after the disappearance – a route that ends approximately where the body was found.

And then there are Esteban's own words. In a phone call to ABC7 on May 31, Esteban said, "I openly hate Michelle," but she denied killing her.

I work in Le's hometown of San Mateo. Very sad case. Saw a recent article where someone said the lesson to learn is that most murder victims know their attacker.

OAKLAND (BCN) ....Defense attorney Andrea Auer admitted that the prosecution has "a mountain of evidence" against Esteban, 28, but told jurors that she doesn't think it will be able to prove that Esteban committed either first- or second-degree murder...

Although prosecutor Butch Ford provided tape recordings and text messages showing that Esteban talked about killing Le as early as Nov. 19, 2010, six months before Le disappeared on May 27, 2011, Auer said Esteban didn't premeditate killing Le but instead acted "out of extraordinary provocation and the heat of passion."...

In his hour-long opening statement...Ford alleged that Esteban killed Le out of "jealousy, hatred and rage" ...

Ford said Esteban went to extraordinary lengths to find and hunt down Le, including ...using false names to obtain information about Le from staff members at the nursing school.

He said the day before Le disappeared, Esteban stole an employee's photo identification card so she was able to enter Samuel Merritt University after normal business hours and access documents which revealed Le's personal information, such as her phone numbers and addresses...

It sounds like the prosecutor's case is really strong.
