UPDATE: An attorney has released a statement on behalf the Kimbley family.
Their son, 2-year-old Jake Kimbley, was found dead yesterday morning near their home.

XXXXXX ‎@Jolisa I have a daughter who is 9 now that is mentally challenged and she is just now getting the concept of hide and seek. But not even the hiding part, she stands with her head on something and counts 1,8,10,8 here come! And then runs around to find her brothers who are hiding. She tires of looking quickly in our back yard that has no woods and they are hiding right where she can see them. I guess it depends on how mentally challenged he was, as to whether or not it is possible. I did see someone else post how does a mentally challenged 2 year old take off their own clothes? If the child could walk he can take off his on clothes, just because they say mentally challenged does not mean they can't do anything!

XXXXXX I don't know this child nor the family personally but after working with special needs children for 11 years you see diagnosis "fads" every child who had a questionable "flaw" used to be labeled as having Cerebral Palsy. Now the new trending diagnosis is Autism. I have a large amount of friends who spend their nights researching cause they think their child is sick.
Not saying this child didnt have it, but I'm not sure he did either.
Either way, it's very sad. And if someone did harm him, I hope the punishment in return in not a slap on the wrist. We've seen enough of that already in East Texas

Later that night, before the 2^nd search, that woman and her husband stood 5 feet away from our team laughing, not assisting in the search, etc. I understand their lawyer is making a statement on their behalf, but he wasn't there. Guess at the very least they are going for endangerment and have arrested both parents at their CPS hearing. They have plenty even if the autopsy is still pending to go after the endangerment charges now.

***Parents of toddler found dead in septic tank charged child endangerment***

SMITH COUNTY — Parents of 2 year old Jacob Kimbley, who was found dead near his home last Wednesday, have been arrested and indicted on charges of child endangerment.

Sabrina and David Kimbley were arrested during a hearing in a Smith County courtroom on Thursday, August 30^th, just before 5:00pm. They are charged with child endangerment.

Officials with Child Protective Services cited "neglectful supervision" of so many children, which resulted in Jacob's death, as the reason for the indictment.

Their five remaining children have been in foster care since the incident, and will stay in foster care during the course of the hearings. KETK has been told that the children are doing fine, and are undergoing medical check ups.

The Kimbley's will not be allowed to visit their children during this time.

KETK has been told there will be several more hearings over the next few months.

KETK will update this story as more information becomes available.

The parents of toddler Jake Kimbley, whose body was found inside a septic tank near his family's home, are facing charges.
David and Sabrina Kimbley have been indicted on child endangerment charges.
Both David and Sabrina are charged with 13 counts each of child endangerment for the living children.
Each of the 26 total counts are state jail felonies.
The bond on each indictment is $100,000, totaling a $1.3 million bond each.
Sabrina refused the court-appointed attorney; her attorney remains Reeve Jackson.
David accepted the court-appointed attorney, Zack Davis.
Both Sabrina and David have been placed under arrest, but have not yet been transported to the Smith County Jail.
Jake went missing last Tuesday afternoon. He was found last Wednesday morning around 1:30 in his family's septic tank, about 15 feet behind the house in the woods.
The autopsy results on Kimbley have come back twice as pending. More conclusive results are expected in about a month.
CPS took five children living in the Kimbley home into state custody last week. A routine hearing to determine what kind of rights the Kimbleys have to the remaining children was Thursday afternoon.
The five children are still in state custody, placed in separate foster homes. The next hearing regarding the parent's visitation rights will be held next Friday.
The case involving the death of Jake Kimbley is still pending, and is currently under investigation.

XXXXXX Here's a few tidbits that I was told about today's hearing from someone that was there: (Nobody shoot the messenger, my life insurance still goes to my ex til my baby turns 18)!!!

-The states attorney said that gpa fathered 2 of Sabrina's sisters kids.
-The investigators took a LENGTHY video of the condition of the home which was shown. ABSOLUTELY HORRIBLE!!
-Kimbley attorney objected at least 7 times during the video alone, stating that the video was hearsay, and that the pest infestation was amplified by the photographer and investigators. Also stated that since the video was taken on 8/26, the Kimbley's weren't at fault for the condition of their home and that investigators caused the mess.
-Video showed indescribable amounts of roaches ... everywhere, dead & alive. In drawers, frig, food, stove, washer, dryer, toothbrush holder, on dishes, EVERYWHERE!!
-There is only one working window unit AC in the home, guess where? Master bedroom.
-Between all the children, they only had one bed - a blue racecar bed that was chewed up by rodents. The twins slept on the floor.
Public Health Sanitation expert examined the house and testified. Worst case of roach infestation she has ever seen. MULTIPLE code violations inside and outside the home
-Kitchen not appropriate for food preperation - mud/roaches in the stove
-Toilets did not work. Black water in tubs. Fecal matter smeared on the wall. No plug covers. Multiple fire hazards. Abandoned well on the property. House was beyond being repaired or cleaned. The family would have to move.
-They've been renting there for 3-4 yrs and said that the roach problem has just recently become an issue.
-The Kimbley's did not bring the children to the scheduled interview with CPS the day after Jake was found for a forensic interview.
-Andrew often in charge of all the children.
-2 marijuana pipes found at the Kimbley home which David and Sabrina blamed on the DUI uncle (Ken? or Kim)
-The children have individual lawyers, all requested no contact or visitation. Kimbley's lawyer said that if called as witnesses, the Kimbley's would plead the 5^th on everything due to a possible criminal trial (which now we know they will have)
-A Mrs. Davis is some kind of expert (didn't catch the exact title) but is out right now. Judge wanted to hear from her before allowing any visitation/contact. This is why the ⁹⁄₇ court date was scheduled.
-Attorneys spoke about each child they were representing...David openly cried during this portion... They are safe and CPS is arranging counseling. They all acknowledge what happened. Andrew is described as very articulate and "feels responsible" for what happened to Jake. Children are behind on shot records, girl had lice, all need eye exams, one needs tonsils out....medical care has been neglectful.
-Judge yelled at the Kimbley's atty stating that she can't make a decision when she doesn't know why a 2 yr old ended up in a septic tank! They have to err on the side of caution and protect the children!

I swear, I got queasy watching that video and a few times I even said "aaaaack!" out loud and had to look away. It is bad. Dead AND live roaches in the refrigerator... unfuckingbelievable!

They need to lock all the adults in that family in the house and burn it to the ground. The roaches would probably survive, though.
