PRESS RELEASE

Members of the New York State Police Gun Investigation Unit arrested a husband and wife from Colonie, New York on Tuesday, January 15, 2013 for Criminal Purchase of a Weapon, Criminal Possession of Weapon 4^th and Endangering the Welfare of a Child.

The NYSP-GIU, with the assistance of the Colonie Police Department, arrested ERIC L. COLEMAN (pictured), 45, and DAWN COLEMAN (pictured), 35, both of Colonie, after an investigation was conducted indicating the couple appeared to be making an illegal purchase of a Windham Weaponry .223/5.56mm model WW-15 semi automatic rifle from B&J’s Gun Shop on Central Avenue in the town of Colonie.

On January 15, 2013 members of the NYSP-GIU conducted surveillance of the gun shop in anticipation of the couple returning to complete the purchase of the semi-automatic rifle. Once the couple arrived at the gun shop, they completed the necessary paperwork and also purchased ten boxes (200 rounds) of .223 caliber ammunition for the rifle. All paperwork for the transaction was completed by DAWN COLEMAN. Prior to exiting the store, the weapon was taken into possession by ERIC L. COLEMAN who in fact has a prior felony conviction for Criminal Possession of a Weapon 3^rd and therefore cannot legally possess any firearm, rifle or shotgun. As the subjects exited the store, they were taken into custody in the parking lot with the weapon and ammunition without incident and transported to Troop G SP Latham for processing.

ERIC COLEMAN was charged with Criminal Possession of a Weapon 4^th and Criminal Purchase of a Weapon. DAWN COLEMAN was also charged with Criminal Purchase of a Weapon and Endangering the Welfare of a Child for leaving their 10-year-old daughter unattended in their vehicle in the parking lot of B&J's Gun Shop while they were inside conducting the transaction.

The semi automatic rifle and ammunition were secured as evidence by the NYSP-GIU. Both defendants were issued appearance tickets returnable for the Town of Colonie Court on January 23, 2013.

If Mrs. Coleman passed a background check and had gone to the shop and picked up the guns and ammo alone, she wouldn't have been subject to arrest on the spot (unless the purchases are on the banned list, in which case I'd think the shop owner would be charged too).

My husband is having all kinds of fits because the New York law will limit the size of the clips..going from 10 down to 7. I am on the side of why do you need an assault rifle anyway? And why the big clip. Husband is with the folks who answer "Because".
I want to support a person's right to bear arms, or arm bears, whatever. But then I see Newtown, and the firefighters right here in my hometown ..senseless killings. But I also can understand that the Newtown kid, and the old fart here both aquired their firearms through illegal means.
So there I times when I am not sure where I stand on the issue. This is making my head hurt.

QueenBee, 7 round mags are oddballs. There are not a lot of firearms that use that number or less. Most are 10 rounders, 12, 15, 16, or above. This 7 round number is making it very hard on gun owners in NY. I feel your hubbys pain.
What it almost does is set us back to the days of the sixguns [think cowboys and revolvers and how fast and much lead they could spray in a short period of time]. It will be no safer, just harder on the good guys.

I know we have turned down sales because two people will walk in , one guy looks the guns over and picks one out and then the other will say I will take it. A dealer has the right to refuse a sale. We/they will catch some grief for it but as soon as we point to the security camera it stops the arguing quick.

If the dealer alerted LE, I think the dealer did the right thing too. This is an example of community members being aware and responsible, and LE following up actively. Mrs. Coleman was making a straw purchase for a felon. Illegal. Had LE not been tipped and on the scene when possession transferred from she to her husband, who knows what would have happened next.

I read that the Tucson mass murderer who shot Gabby Giffords was denied a gun purchase by a Walmart clerk because the clerk considered him to be acting irrationally and unstable. Good for the clerk; even better if authorities had been alerted.

Those behind the gun counter can make a big difference in keeping guns out of the wrong hands, if they're empowered and educated to do so. I know no one wants to feel like a snitch, but I think it's really just the right thing to do for everyone's safety and ultimately for business (the more crazies that going on killing sprees, the more calls for increased gun restrictions - stop 'em in their tracks).

I hope that a lot of people who work in gun sales share your mindset.

So this is interesting in the sense that it again shows that the AR-15 - or any assault rifle for that matter - aren't widely used for killing. They never have been.

HotD, this is why I get heated about this subject... it's all about intellectual dishonesty. Now to be fair, this info-graphic could be construed to be intellectually dishonest as well, because it is clearly excluding handguns. But the recent gun control push has been focused squarely on assault rifles, so I guess they are trying to stay on point.

At any rate, this isn't about assault rifles, because statistically they aren't the problem. Handguns are a much bigger problem, but the politicians know they can't win on that argument because most people don't perceive them such.

But hold up an AR-15, and the politicians know they can gin up the base and scare the bejeebus out of people. They move to ban, and include other provisions that affects all guns. It's a version of the old Potomac Two-step.

It's political opportunism. It's not letting a crisis go to waste. And it's shameful... if Obama and the Democrats really cared, why didn't they just push gun bans at any time between 2008 and 2010 when they controlled the entirety of the Legislative and Executive branch? You already know the answer to that question I'll bet.

That's why I get heated.

I'll be waiting for the legislation to ban hands and feet, since I am twice as likely to be killed by them than with an assault rifle. Also, cutting vegetables will be much tougher when they ban those pesky knives too.

ETA: In their rush to ban guns in NY, law enforcement officers were not excluded, so they are all currently breaking the law until a fix is passed. But yes, let's trust legislators because they know what is good for the people. Dopes.

Nothing wrong with being hot and I get what you're saying Jimbone; always have. I agree that there is a lot of political theater and fear-related opportunism going on in the wake of the Newton shootings, as it relates to new/renewed bans.

Where I disagreed with you previously was in the (seeming) stance that anything put forth in the new proposals was tyrannical and should be disregarded. I actually support the administrative and enforcement portions of the new gun control proposals; those which will pass by executive order. Those portions of the new control laws are separate from restricting guns and ammo and instead focus on limiting the people who have access to any guns (banned or not).

As I've said before, rational and responsible people with guns (1 or 500, semi automatic or single shooters) don't concern me. Unstable, violent and irresponsible gun owners do. If I've understood your last couple of posts correctly, I think we're on the same page there.

I heard that gun deaths are the third leading cause of death for kids under 18. I don't really care about the types of guns but yeah, it would be nice (albeit maybe impossible) to make it harder for the crazies, criminals and those with I.Q.'s of a squash to own them.

I read there were 3 accidental shootings at gun shows this weekend. Nobody seriously hurt.
