"In highly volatile or dangerous situations, a LEO's authority to require compliance is much higher than in non-threatening contexts. The Supreme Court has ruled (with Terry v. Ohio being one of the primary cases) that the police are allowed to protect themselves from potentially dangerous people or situations. Under the umbrella of "concern for safety" or "search for weapons" the police have wide latitude to do what they want and to order citizens to comply with their demands.

The Terry v. Ohio case created the "weapons search", "terry search", or "terry pat" exception to the 4th Amendment 'probable cause requirement' for searches. The court ruled that if a police officer "[has] reasonable cause to believe that [someone] might be armed" they can require they submit to a quick patdown. What this has meant is that it is now standard practice to pat down anyone that a LEO wants to, without the need for arrest, probable cause, or even suspicion of a crime.

Many police use weapons pats as a way to intimidate and harass citizens, since it is a power the courts have allowed them to use with little justification. Often a LEO will find something during their patdown which is clearly not a weapon which they would like to see, but this is beyond their Court-approved authority ( see below ).

Also under the 'concern for safety' umbrella, police are given wide latitude by courts to ask individuals to comply with simple non-intrusive commands such as "stand over there" or "wait here for a moment", but the line between order and request becomes very fuzzy when an officer starts telling people where to go unless the situation is volatile / dangerous. There are many stories of two (or more) individuals confronted by police whom the police intentionally separate to try to intimidate or to compare stories. This is generally a 'fishing' maneuver which would not fall under the 'concern for safety' umbrella."

She should have gone in the house when told to do so. But I don't think she should have been arrested. Yes, cops are arrogant. But they also put their lives on the line everyday for us. A routine traffic stop can turn into that officer being shot and killed by some idiot. Get your ass in the house and let the officer do his job. Film through the window if you feel you have to record what is going on.

Don't most patrol cars have cameras in them these days anyway?

Sorry a traffic stop is not a crime scene, the officer had no jurisdiction over other people just the ones in the car, He over stepped his bounds in ordering citizens into their houses.

I know what I'm talking about I was watched to many times to count when doing traffic stops, people would pull over and watch to see what's going on, it always boils down to the same thing, the only ones who are detained and controlled by the officer are the ones in the car that was stopped.

I mention crime scene because that brings up a special set of circumstances that allows an officer to keep people back and away from the scene usually with a tape that sets the limits, but he still has no authority to make them go home or in their houses if they want to stand at the tape and watch it's their right in a free society.

It's an irritation to me to see people turned into sheeple and feel like they have to do everything that they are told, it will be the ruination of this country if it continues.

I believe the question was raised in post #24. "How does the video taping of this event prove racial profiling?"

The alleged profiling would have occured before the stop. In fact, it would be the basis FOR the stop.

The video was recording events after the stop.

"Sensational" video garners attention . . . the public's AND to the videographer. Sometimes financial rewards.

Her reason for being there with a camera was strictly for "possible" personal rewards. Spotlight or cash.

Let's cut the bullshit. She was as genuinely concerned about possible "racial profiling" as I am about getting prostate cancer.

This is raw video caught on tape of a woman at the scene of a rollover accident that she was involved in, and she is clearly upset with state troopers over something. She tries to get them to taser her and take her into custody along with her husband who was just arrested for suspicion of DWI.
