MURDERED: 8 yr old Leila Fowler - 12 yr old brother charged

The DA decided to charge the 14-year old as an adult based on the details of the investigation.
"There was certainly a connection here, many of the suspects and the victim have been involved with drug trades in the past," said Santa Maria Police Chief Ralph Martin.
According to the original investigation, Ibarra's death involved the dealing of street drugs.

I wonder where the 10 year old is staying and what's going on with that case.

Maybe the 10 year old is being processed through Juvenile Justice, but isn't in a juvenile detention facility because he had an existing anger management issue, apparently managed by medication. Doesn't seem like he or his adoptive mother denied the killing, based on the article.

Anyway, the fact that the 10 year old is facing similar charges in California's Juvenile Justice system might make it even less likely for Isaiah's attorneys to get anywhere with the claim that he's too young to go the same route. Precedent.

There doesn't have to be any precedent. If the Fowler son probably did it he will be adjudicated. The lawyer is just blowing smoke.

I don't think they're counting on a dismissal based on age either.

While there doesn't need to be a precedent to blow the smoke out of the room, doesn't hurt that the state has a case of an even younger defendant who's already been similarly processed with which to counter.

Guess we'll see what happens in July, unless the defense attorneys follow through with a dismissal motion before then.

More from the defense attorneys following yesterday's hearing:

Reichel says one major issue in the case is the age of the defendant and his ability to understand the situation.

"Trying a 12-year old is a very difficult question, we don't have the answer yet on whether that's even possible," explained Reichel. "It's the issue of a 12-year-old that we are concerned about and whether or not a 12-year-old can go through these proceedings, can be on trial in such a serious case, and can actively participate to the point that the trial resembles what we call fundamental fairness."

Reichel says he expects the defense will spend 10,000 hours examining evidence which is still coming in. Fowler will return to court July 31st to set a trial date.

In the statements from the attorney I am getting he is not saying he is Innocent. He is stating that he feels the 12 year old does not understand what he did. I feel is completely BULLSHIT. NOWADAYS a 12 year old knows more then some adults. Especially living in a house with several older siblings.

I think an insanity plea would be easier then this "to young to charge with murder". If this child did the crime, he should be held accountable.

The attorneys are reportedly saying that they believe Isaiah is innocent, and that the boy may be too young to stand trial, and that they've got a lot of evidence to sift through. I think that the attorneys simply have so much more to comb through and to strategize that they have no real game plan as of yet. They're just tossing out claims that are non-committal but look favorable to their client in the meantime.

Isaiah is confined in a single cell in a juvenile facility, goes to the jail’s school and works out at the jail, the attorney said.

Reichel told Reuters that Isaiah was suspended from school in January for bringing a Swiss Army knife. Aside from that incident, the lawyer said the 12-year-old is “a very normal boy in a normal setting with normal siblings.”

The Fowler family moved to an “undisclosed location” since the charges. One of Isaiah’s attorneys, Steve Plesser, told KCRA that the family is “unsettled.” He said he was trying to get the boy released to his parents while he awaits trial, but hasn’t yet asked a judge to follow through on the request.

"We don't have the best release plan in place at this point," the attorney said. "The family hasn't had a chance to get a firm foundation on their home life yet."

Sorry this comment makes me laugh "Reichel told Reuters that Isaiah was suspended from school in January for bringing a Swiss Army knife. Aside from that incident, the lawyer said the 12-year-old is “a very normal boy in a normal setting with normal siblings.”

Seriously? Just a normal boy does not bring a knife to school, and get suspended for said knife. It would make all the more serious is if he threatened someone with the knife. How did he get caught?

I have to disagree with this. My brothers all carried knives, usually a buck knife so did all their friends and they were the same age if not younger than this kid. I don't think a kid who carries a knife should automatically be labeled a bad kid. I understand that many kids are coddled these days & a lot of parents would have a shit fit if their kid carried one.

Question - do you come from a family of hunters? Because that is common for hunters. And NOWADAYS is so different compared to when I went to school, carrying a knife is MORE serious then it use to be. (mind you I am in my early thirties)

In this day, I would consider it more serious then when I was in school. But again this is just my opinion.

Having worked with DYFS, Department of Children and Family, he would not be allowed to be released to the mother and father if they have small children. Due to the charge he has been charged with this would void him from being around young children.

Aside from that, the parents should want to keep their other children safe. Away from him. Obviously they know he did it. I really do not think that the PD would waste their time on a 12 year old if it was not for evidence against him or even his own word.

I think it's unfair to label people. I get that kids can't carry that kind of thing to school these days but normally parents won't be okay with their kid having something like that unless they are responsible.

One of the nation's biggest, most well-known neo-Nazi organizations, the National Socialist Movement idolizes Adolf Hitler and touts virulent rhetoric against those who are Jewish, immigrants and not "pure-blood whites," according to the Southern Poverty Law Center civil rights group.

Prosecutors contend the victim's neo-Nazi background is not linked to his death, saying the young killer's concerns about abuse and his family being split up were more significant factors.

If they try for an insanity plea I hope it does not go thru. I hope the courts will realize he was sane enough to make up an intruder story and hide any evidence and keep police searching for a man that did not exist.

Every picture and video I have seen that shows Isaiah he looks emotionless and shows no sign of remorse what so ever. Even in pictures that were on crystal walters facebook with him in them long before the murder he looked like he was evil. nothing but a blank emotionless stare.

He knows what he did and his lawyers know what he did. But its their jobs to get him off no matter if they think he did it or didn't. To them its nothing but a publicity case for them.

This whole thing reminds me of O.J. Simpson.

That little pos, as you call him is a juvenile. Even though he will be held to answer to charges filed, his background, his upbringing, will come into play. It is very rare for a 12 year old to murder, much less their little sister. If it comes down to emotional issues, then the courts will look toward the family. And it seems the only consistent family that he has had is his dad.

And his dad may have emotional issues of his own, considering his inability to maintain a healthy relationship with women. Lots to look at here. I'm still thinking that dad may just be a misogynist.

Just want to emphasize. That every link, I have linked, goes back to family issues, or cognitive issues. Show me where Isaiah Fowler was special ed and I might give the family a break.
