Would the reading of the affidavit disclosed evidence and that's why he choose not to have it read? If this is a dumb question please chalk it up to me not knowing better.

I rarely, if ever, see dumb questions in here.

Sometimes defendants want to skip a probable cause hearing to avoid public exposure.

Sometimes they know there's probable cause to support the charges against them, so why bother having an attorney argue it at the hearing, thereby showing their defense-strategy hand before it's necessary. I believe that's the most common reason that defendants, typically on advice of their attorneys, choose to waive the hearing and instead let it go directly to a secret grand jury.

I said it like that because I've been trying to find out about Ramirez' pension and if it would be forfeited. The legalese is mind numbing.

There's been public uproar about dirty cops (and other public workers) getting to keep some or all of their pensions when they resigned prior to felony convictions in Philly, Chicago, the state of Wisconsin...

I wouldn't be surprised if Ramirez gets to collect retirement benefits while his case is pending. He is innocent until proven guilty in the eyes of the law and the state.

If he's convicted of the felony charge though, I imagine the Toledo PD will elect to lawfully terminate his retirement benefits, with the exception of what he contributed to the pension plan during his years of employment. Ramirez could then challenge or appeal that action in court.

I've seen this section of it cited many times in the media reporting, Wildflower, but haven't seen the Affidavit doc published yet.

An affidavit states there was “evidence of communications between the defendant and another,” and the evidence was deleted “in an attempt to shield the defendant's involvement in a felonious assault plot.”

I'm nosey too, but have been coming up empty.

I got the impression that the media picked up the quote from the Affadavit based on what was said at the arraignment and the press conference, rather than having gotten a copy of it.

But, I don't know for sure; wish we could get our hands on it.

If it's out there somewhere, I know you'll find it. Smiley_emoticons_smile

Google's the way to go, for me too. I've tried several different search phrases since the arrests, but haven't hit on anything.

Checked the court docket site for Lucas County as well and haven't seen it as an attachment.

If it's not been made public yet, hopefully the press will petition the court to release it, as they have in other cases.

After I read about 4 former cops receiving their pensions after being filmed snorting coke & discharging their weapons into a ceiling I knew the chances of Lt. Ramirez receiving his was a very good possibility.

I was reading that the union contracts make sure they receive their pension...the part that they've paid in. The part that the city has paid in can be revoked for restitution. I'd bet the cost to take that bit of money from him would cost more than the money they'd get, though.

I think they're fucking dropping charges against her! or maybe the obstructing justice ones I dont see them on the other one although it does say indictment Nolle prosequi entered / indictment.
