It's not clear to me whether the police are prohibiting the burial of Tamir, or if the family is afraid to bury him before the criminal investigation is complete in case he needs to be examined again. Either way, it's sad.

The investigation is finally completed and has been turned over to the prosecutor's office.

The Cuyahoga County sheriff's department said Wednesday its investigation into the shooting of Tamir Rice, which has stretched nearly four months, is complete.

"My department has been diligently working on the investigation. We have concluded our work and I have turned it over to the prosecutor who will take it through the next steps," Cuyahoga County Sheriff Clifford Pinkney said in a statement.

The county prosecutor has said the case will be presented to a grand jury that will determine if criminal charges are filed.

Tamir's family currently has a civil rights lawsuit pending in connection with the case. Earlier this week, a federal judge delayed part of that lawsuit, citing concern for the officers' rights against self-incrimination. The judge's ruling doesn't delay the lawsuit as it relates to the city of Cleveland.

Yeah, it happens a lot when victims' families file a civil suit against the defendant(s) before criminal proceedings for the same alleged crime have concluded.

In a civil suit, the burden of proof is much lower for the plaintiff as compared to a criminal trial. If the defendants are deposed and compelled to provide testimony in the civil suit, that testimony could then be disclosed and used against them in the criminal case. That would compromise the defendants' right not to testify in criminal court.

It's better for the criminal proceeding to come first in all fairness, IMO.

The Rice family filed a civil suit against the two officers involved in Tamir's shooting and the city of Cleveland. Since the city of Cleveland is not a defendant in the potential criminal case, that part of the civil suit has not been delayed.

I'm guessing criminal charges won't be filed against the officers, and if they do go to trial, I don't think they'd be convicted.

Not sure about the civil suit.

Probable Cause for Both Officers To Be Charged

Tamir Rice was killed 7 months ago

A Cleveland Municipal Court judge said Thursday there was probable cause to charge Officer Loehmann with murder in the killing of 12-year-old Tamir Rice, according to Cleveland.com.

The judge also found there was probable cause to charge officer Frank Garmback, Loehmann's partner, with involuntary manslaughter, reckless homicide, negligent homicide and dereliction of duty.

Judge Ronald Adrine found that there were grounds to prosecute the officers, but he notes in his decision that he is acting in an "advisory" role and that ultimately a grand jury will decide whether charges are warranted.

Adrine's decision notes that in surveillance footage of the incident, “there appears to be little if any time reflected on the video for Rice to react or respond to any verbal or audible commands given from Loehmann and Garmback from their [car] between the time that they first arrived and the time that Rice was shot.”

I just checked the status Duchess.

Tamir's mom, Samaria Rice, had him cremated on May 14th.

She waited 6 months, in case the body needed to be re-examined in order to get what she considers justice for her son.

But, the investigation kept dragging on without a decision regarding charges and she decided she couldn't wait any longer to lay him to rest.

That kid was just headed for a life of crime and thuggery anyway. If those good police offers hadn't taken him out, it was only a matter of time before he went on a crime spree and ended up either in jail or dead.

Not that this is relevant but our area is on an odd/even watering schedule now because of the drought. Odd numbered street addresses can water Mon/Weds/Fri and even numbered addresses Tues/Thurs/Sat. Today is one of our watering days. I plan to use at least half our allotted water amount taking a nice, loooooooong shower with the clit zapper. 17
